California has no separate title loan statute. A title loan here is a consumer loan secured by your vehicle, made under the California Financing Law by a lender licensed with the Department of Financial Protection and Innovation. The law caps interest in three bands by loan size and spells out what a lender must do before and after a repossession.
| Rule | What California Allows |
|---|---|
| Legal structure | A consumer loan secured by your vehicle's title, made by a DFPI-licensed lender under the California Financing Law |
| Interest below $2,500 | Tiered monthly caps that step down with size: 2.5% per month on the first $225 of unpaid balance, 2% up to $900, 1.5% up to $1,650, and 1% above that (§ 22303) |
| Interest from $2,500 to $9,999 | 36% per year plus the Federal Funds Rate, about 39.63% as of August 2026 (§ 22304.5, added by AB 539) |
| Interest at $10,000 and up | No state rate cap |
| Amount | No state minimum and no state maximum |
| Administrative fee | Up to $75 on loans over $2,500, and the lesser of 5% or $50 at or below $2,500; only one fee until the loan is repaid, and no new fee on a refinance within one year (§ 22305) |
| Term | Monthly installments; a loan of $2,500 to $9,999 must be scheduled over at least 12 months, and the ceiling grows with size to 60 months and 15 days at $3,000 and above (§ 22334) |
| Late fees | $10 after 10 days late or $15 after 15 days late, charged once per missed payment (§ 22320.5) |
| Repossession | After default the lender may repossess, then must send at least 15 days of written notice before the vehicle can be sold (§ 22328) |
| Redemption | You may get the car back during the notice window by paying the balance in full, and one written request extends the window by 10 more days (§ 22328) |
| Deficiency | If the notice was properly given within 60 days of repossession, you remain liable for any shortfall after the sale (§ 22328) |
| Surplus | If the sale brings more than you owe, the surplus must be returned to you within 45 days (§ 22328) |
Most California title loans fall in the $2,500 to $9,999 band, where the cap is 36% per year plus the Federal Funds Rate. The federal piece moves over time; it is read from the Federal Reserve's H.15 release as of the first day of the month before the loan is made, and it puts the ceiling at about 39.63% in August 2026.
Interest is simple interest on the unpaid balance for the days actually elapsed, so every payment shrinks the balance next month's interest is figured on. A one-time administrative fee of up to $75 can be added at the start.
The table shows the statutory maximum with that fee included, not a quote; the APR column counts the fee, which is why a smaller, shorter loan shows a higher APR than the capped rate alone.
| You Borrow | Term | Monthly Payment | Total You Repay | APR at That Maximum |
|---|---|---|---|---|
| $3,000 | 12 months | $315 | $3,774 | ~44.7% |
| $5,000 | 24 months | $310 | $7,428 | ~41.3% |
| $8,000 | 36 months | $387 | $13,923 | ~40.4% |
A longer schedule lowers the monthly payment but raises the total interest, so the cheapest loan is the largest payment you can comfortably carry over the shortest term. What a lender offers you depends on your vehicle, the amount, and your income.
Governing law: the California Financing Law. Section 22304.5 holds the 36% plus Federal Funds Rate cap, section 22303 the sub-$2,500 tiers, section 22305 the fee limits, and section 22328 the repossession, notice, redemption, and deficiency rules. Lenders are licensed and examined by the California Department of Financial Protection and Innovation, which also takes borrower complaints.
