Title loans are legal in Indiana and are regulated by the Indiana Department of Financial Institutions (DFI). They are made under the supervised loan provisions of the Indiana Uniform Consumer Credit Code, which was recodified on 1 July 2026 as Title 37, Article 2.
Indiana caps the price. Under IC 37-2-4-35 the finance charge may not exceed the greater of two limits: a tiered rate of 36% a year on unpaid balances up to $2,600, 21% on the part between $2,600 and $5,200, and 15% on the part above $5,200 — or a flat 25% a year on the unpaid balance.
Because the tiers apply to the unpaid balance, these are installment loans that you pay down over time, not single-payment balloon loans. You can pay off early at any time without a penalty.
| Rule | What Indiana Allows |
|---|---|
| Legal structure | Supervised loan under the Indiana Uniform Consumer Credit Code (IC 37-2-4); lenders licensed by the Indiana Department of Financial Institutions |
| Rate cap | The greater of 36% / 21% / 15% a year (tiered by unpaid balance: up to $2,600, $2,600–$5,200, above $5,200) or 25% a year (IC 37-2-4-35) |
| Prepaid finance charge | Nonrefundable charge of no more than $75 (principal $2,000 or less), $150 ($2,000 to $4,000) or $200 (above $4,000) (IC 37-2-4-35(h)) |
| Loan structure | Precomputed loans are prohibited — you pay down the unpaid balance in installments |
| Refinancing | Refinancing and consolidation are permitted (IC 37-2-4-8, 37-2-4-9). If the same lender pays off your loan with a new one within 3 months, no new nonrefundable prepaid finance charge may be added, and no more than two such charges in any 12 months (IC 37-2-4-35(j)) |
| Late fee | Up to $25 on an installment unpaid 10 days after it is due ($5 where installments fall due every 14 days or less) (IC 37-2-4-6(a)(2)) |
| Returned payment | Up to $25 |
| Prepayment | No penalty |
| Repossession | Permitted on default |
| Criminal prosecution | Not permitted over an unpaid title loan |
The table below shows a 12-month installment loan at Indiana's maximum permitted finance charge. These are the statutory ceiling, not a quote — your own agreement will show your exact rate and total.
The figures are interest only. A nonrefundable prepaid finance charge of up to $75, $150 or $200 (by loan size) may be added on top, and must appear in your written disclosure.
| Loan amount | Term | APR | Finance charge | Total repaid |
|---|---|---|---|---|
| $1,000 | 12 months | 36.0% | $206 | $1,206 |
| $3,000 | 12 months | 35.5% | $608 | $3,608 |
| $5,000 | 12 months | 31.9% | $906 | $5,906 |
Every Indiana title lender must hold a licence from the Department of Financial Institutions, and you can check one before you borrow on the Indiana Department of Financial Institutions licence search.
Under the federal Truth in Lending Act the lender must give you the APR and the total cost in writing before you sign. You can repay in full at any time with no prepayment penalty, a returned-payment charge is capped at $25, and you cannot be criminally prosecuted over an unpaid title loan. Complaints go to the Indiana Department of Financial Institutions.

Before you sign, be clear on the payment, the number of payments, and the total you will have paid when the schedule ends. The figures in your own agreement are the ones that count, not the examples on any website — ours included.
A title loan is one way to cover a shortfall, and it is worth putting it next to a few alternatives before you commit your car's title. A credit union small-dollar loan, a payment plan negotiated directly with the biller, a paycheck advance from your employer, or help from a local assistance programme will often cost less. If none of those work, borrow the smallest amount that solves the problem and pay it off as quickly as your budget allows.
Keep your vehicle in the picture too. The title is the security, so a loan you cannot repay puts the car you rely on at risk — and in most cases that car is worth considerably more than the loan.
